SHORT-TERM RENTAL AGREEMENT

 

Between the undersigned:

LOCATION:

Please refer to the Welcome Guide for your gîte for all information regarding the address, directions to the gîte, where to park, who to call to notify of your intended arrival time, etc. Information for each listing can be viewed on: www.laclefdecamp.fr

 

SECURITY DEPOSIT:

A security deposit of €500 per gîte booked or €2,000 for La Maison des Bruyères and Le Domaine de Lalie must be paid through a debit/credit card pre-authorisation via the sp plus system on the day of your arrival or the day before you arrive

We will send you a link for a hold to be put on that amount for 6 days. If there is nothing to report when you leave, this sum will be released automatically 6 days later.

In the gîte, you will find a Schedule of Condition, together with photos of any general wear and tear in the accommodation and an inventory for the kitchen and games.

Owing to the current health situation, we ask guests who have not taken out the “Bedding” option to email us photos of their beds, once made up, on the day of their arrival. If we do not receive anything, we will assume that guests have slept on the beds using uncovered duvets and a charge of €25 per bed will be levied through the card pre-authorisation for washing duvets, pillow protectors and mattress covers.

On the day of your arrival, you can email us photos of any observations regarding the Schedule of Condition at Check-In which we send you by email. No observations will be admissible after the day of your arrival.

 

 

If we do not receive any email from you, this will be taken to mean that you tacitly agree with the Schedule of Condition at Check-In.

Unless proven otherwise, if no Schedule of Condition has been produced, the Lessee is presumed to have taken receipt of the rented property in good condition and in a good state of repair and working order and must return said property in the same condition (Article 1731 of the French Civil Code).

 

 

  • If you stay a week or more you will have to plan during your stay to redo this bank imprint, because the bank imprint blocks the deposit only for 6 days.

 

 

CIVIL LIABILITY CERTIFICATE:

A copy of your travel insurance certificate including civil liability cover must be sent to us prior to your arrival.

 

 

GITE ACCESS AND ENVIRONMENT:

Please refer to the listings to find out whether or not pets are allowed in the gîtes. Dogs classed as category 1 or 2, known as “dangerous dogs”, are banned. Animal waste outside must be picked up and disposed of every day and especially before your departure.

  • Smoking is strictly prohibited indoors and fireworks cannot be let off on the Property. Failure to observe this ban shall result in a charge of €250 being levied from your security deposit.
  • Waste must be sorted as indicated and waste bins must be placed in the containers provided for this purpose.
  • Please dispose of glass bottles in the container (cf: Gîte Welcome Guide)
  • If your waste has not been sorted or glass has been left in the house when you leave, you will be charged €50, taken from your security deposit.
  • Please put the indoor and outdoor games back where you found then on arrival.
  • Similarly, all furniture and furnishings (books, ornaments, beds etc.) moved during your stay must be repositioned correctly even if you opt to pay the Cleaning supplement. You may be charged for the time taken to return everything in the house to its original position. Thank you for your understanding and for treating our cleaning staff with respect.
  • Any visit to the gîte in advance of the booking will be subject to a charge of €20.

 

 

 

NOISE DISTURBANCE & GITE RULES

A reminder:

As stated in Article R. 1334-31 of the French Public Health Code: “No sound shall impinge on the peacefulness of the neighbouring area or the health of others, in a public or private place, as a result of its duration, repetition or intensity, whether caused by a person directly or by something or someone in their charge or by an animal for which they are responsible”.

  • Making noise outdoors or indoors is prohibited. Please close doors and windows after 11pm. Consequently, the volume must be turned down on sound systems. Some gîtes are close to other dwellings or in a town centre location. Please respect the neighbourhood. If the neighbours complain about your behaviour, a set charge of €400 will be taken from your security deposit. Failure to comply with this rule may result in you being sanctioned and you may be asked to leave the accommodation immediately, without entitlement to any compensation.
  • Fireworks and other outdoor shows are prohibited including the release of lanterns or any other potentially dangerous activity. This is in order to respect the neighbours and the law. Failure to comply with this rule may result in you being sanctioned by the authorities and you may be asked to leave the accommodation immediately, without entitlement to any compensation.
  • Please put out the fire before going to bed. Do not light candles indoors and only smoke outside. Please dispose of your cigarette butts in the receptacles provided for this purpose and do not throw them on the ground. You may also be charged for the time taken to pick up your cigarette butts.
  • By signing this agreement, you also undertake to comply with the spa rules, displayed near the pool and in the Welcome Guide, which can be viewed or downloaded via the listing at laclefdecamp.fr

·       It is forbidden to drink alcohol, eat, have sexual relations or smoke in the spa tub. Please be very careful regarding risks of drowning… Children under the age of 16 and unsupervised minors are not allowed in the spa tub. Never turn the spa tub off and always put the insulating cover back on after use. Poor behaviour and failure to comply with the rules listed in the Welcome Guide may result in this area being closed, without compensation. You will be charged a minimum of €100 for failure to comply with the spa rules.

  • The Spa fee is calculated according to the number of nights booked at the gîte.

 

 

Depending on which gîtes are booked, the relaxation area may be shared with the other gîtes (solely for La Duckerie for the following gîtes: Duckfly, Grande and Petite Duckerie, and Boulangerie)

A schedule is available for you to book your time slot (one-hour slots) to enjoy sole use.

The relaxation area is open 24 hours a day, 7 days a week.

By signing this agreement, the Lessee releases SASU LA CLEF DECAMP, Jennifer Decamp, owner of the gîtes described below, from all liability regarding any possible risks related to the spa, sauna, fireplace, kitchen, staircase, river, ponds, horses or other potential sources of risk.

 

 

Please note that every effort has been made to ensure the gîtes are as safe as possible. The manager, Jennifer Decamp, cannot be held responsible for any inconvenience caused by third parties or other Lessees behaving in an ill-mannered way.

 

GITE PICTURES:

Use of gîte pictures for commercial or promotional purposes is strictly forbidden without the Lessor’s express consent. Where applicable, said consent will be made official through the signing of another agreement specifically pertaining to use of gîte pictures for commercial and/or promotional purposes.

The Lessee shall be held liable for their use of any gîte pictures for commercial or promotional purposes without the Lessor’s consent and without the signing of a specific agreement.

 

 

GENERAL TERMS AND CONDITIONS

This agreement shall come into effect upon payment of the deposit.

  1. a) Check-in time is normally between: 6pm and 7pm. At the Lessee’s request and with the Lessor’s agreement, the Lessee may arrive in the morning, from 10am onwards if the gîte is available. The requested arrival time must be confirmed on the actual morning of your date of arrival, based on gîte availability. There is a charge for this Early Check-In option, as shown on the gîte listing.
  2. Check-out time is normally between: 8am and 10am
  • Subject to the Lessor’s agreement and depending on gîte availability, the Lessee may avail themselves of the Late Check-Out option, if requested, charged at the rate shown on the gîte listing. The Lessee may then leave at any time up to 3pm.
  • If the gîte has been relet immediately after your stay and you have taken out the Cleaning option, the cleaning staff will need access between 12 noon and 1pm to start cleaning in the rooms you are no longer using: bedrooms, bathroom and games room, so as not to disturb you.
  • If you are doing the cleaning yourself, they will need access to the gîtes from 3pm to start disinfecting the property.
  • The disinfection fee is a mandatory charge in all the gîtes. Please refer to the price shown in the listing when you use the booking quote tool. The disinfection fee automatically appears at the bottom of the booking quote.
    This set fee is automatically included in the invoice paid via La Clef Decamp. However, if you have not yet paid this sum following a postponement or a booking through the old version of the website or for a booking made via other means than the La Clef Decamp website, such as through Abritel, Airbnb, Booking etc. you will have to pay this fee on arrival.
  • You will be charged €20 for any item you forget, as well as postage and packing costs to return it to you.

 

 

  1. b) It is agreed that, in the event of withdrawal:

By the Lessee:

  • More than one month before the start of their stay, the Lessee shall forfeit the deposit.
  • However, the Lessee may ask the Lessor if they can postpone their stay instead of cancelling the rental agreement.
  • The postponement will be accepted if and only if another Lessee rents the gîte instead.
  • If the Lessee opts to postpone their stay and said postponement is accepted by the Lessor, the Lessee undertakes to pay the total sum due under this agreement.
  • If there are no new Lessees for the gîte, the postponement request will be refused and the Lessor will keep the deposit paid.

 

Less than one month before the start of the first day of their stay, the Lessee shall also pay the difference between the deposit paid and the equivalent of the total rent, by way of a penalty clause.

 

 

  • However, the Lessee may ask the Lessor if they can postpone their stay instead of cancelling the rental agreement.
  • The postponement will be accepted if and only if another Lessee rents the gîte instead.

 

 

By the Lessor:

 

 

 

  • More than one month before the start of the lease, the Lessor shall pay the Lessee the equivalent of double the deposit paid, in accordance with Article L214-1 of the French Consumer Code.
  • Less than one month before the start of the lease, the Lessor shall also pay the difference between twice the amount of the deposit and the difference between the deposit paid and total rent, by way of a penalty clause.
  • If the Lessor is forced to cancel the agreement owing to an event outside their control (technical problem, flooding, etc.) the Lessor undertakes to offer the Lessee another gîte of at least equivalent value with at least equivalent services, for the same period. Otherwise, if no other gîte can be offered or if the Lessee refuses, the Lessor must refund the deposits paid by the Lessee.

 

 

Specific Covid-19 clause:

 

 

Strict application of French Government decrees or announcements

 

 

For cancellation terms and conditions if we are put into lockdown or if geographic limits are placed on our movements:

  • You will be entitled to a 3-year postponement. This period can be extended by emailing a request.
  • You may book any of the gîtes, subject to availability.
  • You may choose a new date to suit you, depending on availability.
  • You have the option to halve the total credit note amount to make it easier to use.

 

 

If you or a member of your party for the gîte booking have Covid-19 or are a close contact of someone with it, this will not be covered by the postponement clause, so you should take out cancellation insurance, at your own expense, if you so wish.

The person signing the agreement shall be the sole beneficiary of these specific Covid-19 clauses.

We do not take into consideration any friends living abroad who cannot come to the gîte, grandparents who are too elderly, or other friends or family members who might unfortunately be subject to lockdowns, etc.

 

 

  1. c) Obligation to occupy the property in person, to reside there in a prudent and responsible manner and to keep it in good condition. Repairs needed due to negligence or poor upkeep during the rental period will be payable by the Lessee. Obligation to ensure the peace and tranquillity of the neighbourhood is not disturbed by the Lessee or their family. If the neighbours complain about your behaviour or call the police, a set charge of €400 will be taken from your security deposit.

 

 

  1. d) The premises are rented furnished, with cooking utensils, crockery, glassware, duvets and pillows. If applicable, the owner or their representative shall be entitled to claim from the Lessee on their departure the total replacement value of any furniture, furnishings, items or equipment that have been broken, cracked, chipped or damaged, beyond normal wear and tear for the duration of the rental period, as well as the cost of cleaning dirty blankets or covers. Compensation shall also be payable for damage of any kind to curtains, wallpaper, ceilings, carpets, rugs, glazing, bedding, etc.

 

 

  1. e) The Lessor undertakes to take out tenant’s liability insurance for the accommodation on behalf of the Lessee, who must inform the Lessor within 24 hours of any accident or damage occurring to the accommodation, its outbuildings or additional parts. A copy of your travel insurance certificate including civil liability cover must be sent prior to your arrival.

 

 

  1. f) The security deposit of €500 per gîte booked or €2,000 for La Maison des Bruyères and Le Domaine de Lalie must be paid through a debit/credit card pre-authorisation on the day of your arrival or the day before you arrive. If there is nothing to report when you leave, this sum will be released automatically 7 days later. (CF: Further information at the start of the agreement: Security deposit)

 

 

This rental is subject to the following terms, conditions and responsibilities, with which the Lessee undertakes to comply, namely:

 

 

  1. Only use the premises for residential purposes as it is strictly forbidden to carry out any business, profession or trade there and the Lessee acknowledges they are renting the premises that are the subject of this agreement solely as a temporary residence for leisure purposes;

2.  Respect the accommodation capacity for the dwelling;

  1. Respect the purpose of the dwelling and refrain from making any changes to the layout of the furniture or of the premises themselves;
  2. May not substitute for any other person or party, nor sublet, even free of charge, any or all of the rented premises, without the Lessor’s written agreement;
  3. Have tenant’s liability insurance covering theft, fire, water damage and legal claims by neighbours and make sure the furniture and furnishings let to them are insured (either through own insurance policy covering short-term rental risks, or by taking out a specific insurance policy for the full duration of the rental period);
  4. Refrain from discarding into the washbasins, bathtubs or sinks any items liable to cause an obstruction in the pipework, otherwise they will be liable for any costs incurred in returning said equipment to working order;
  5. Raise any complaints about the facilities within 12 hours of checking into the accommodation. Otherwise, complaints will be inadmissible;
  6. Notify the Lessor as swiftly as possible of any damage to the dwelling or to its furniture, furnishings or equipment. The Lessee shall be liable for the cost of any repairs needed due to negligence or poor upkeep during the rental period;
  7. Throughout the rental period, allow the Lessor or any third party authorised by the latter for this purpose, to carry out any emergency repair work. The Lessee cannot claim any reduction in rent if urgent repairs that are the Lessor’s responsibility should come to light during the rental period;
  8. Avoid any noise or behaviour attributable to themselves, their family or relations, likely to disturb or upset the neighbours;
  9. In the case of a rental in an apartment building, respect the joint ownership regulations and/or

the apartment block’s in-house rules, duly displayed, or of which they have been notified by the Lessor or their representative;

  1. Agree to the premises being inspected if the Lessor or their representative so request;
  2. Relinquish any claim against the Lessor in the event of theft or damage in the rented premises;
  3. Take due care of the rented accommodation and return it in a clean condition, in a good state of repair at the end of the rental period. If any items on the inventory are damaged, the Lessor may make a claim for their replacement value.
  4. Any additional options, such as cleaning, bedding, towels, use of the spa, etc. must be booked no later than one week prior to arrival, otherwise there will be a 50% surcharge for each option requested. Our teams need to get organised so as to ensure you the best possible welcome. Thank you for your understanding. We will handle last-minute bookings on a case-by-case basis.
  5. If you book several gîtes on the same property, the rate for the options selected will be applicable to every gîte. These are the options concerned: Spa, Sauna, Early Check-In and Late Check-Out.
